Do you Comply ?

If you own, occupy, manage or have responsibility for Non Domestic premises, by law you are the Duty Holder and as such have a direct resposibility to manage the risks associated with Asbestos.

What does this entail ?

By May 21st 2004 those responsible must have made reasonable steps to comply with the new legislation laid before Parliament on 31st October 2002 (SI 2675 CAWR 2002).

Your Duty

If you own, Occupy, manage or have responsibilities for premises that may contain Asbestos, you will either have:

A legal duty to manage the risks from this material or

A duty to co-operate with whoever manages the risk

A good strategy to manage these materials will help you to prevent risks to workers or others who may use the premises.

How do you comply ?

You must endeavour to;

• Discover if materials containing Asbestos are present.

• Check what condition the materials are in.

• Arrange for material to be sampled and identified by a specialist, especially if you are planning to have maintenance or refurbishment work carried out.

• Record the location and condition of the material on a plan or drawing.

• Assess the condition of the material or its location to decide whether it is likely to be disturbed.

• Prepare and implement a plan to manage these risks.

Survey and Sample for Asbestos

If any major refurbishment is planned for a premises, a suitably trained person should be chosen to carry out the survey of the premises to identify the ACM's.

They will also be able to advise you on what you need to do and what to include in your management plan. You should ask the person or organisation;

• For evidence of their training and experience of such work.
• Is the survey in accordance with the HSE guidance MDHS 100 "Surveying, Sampling and Assessment of Asbestos Containing Materials" ?
• For evidence that they have suitable liability insurance.
• Are they totally independant ?
